An Ordinance further to amend the Indian Stamp Act, 1899 in its application to Uttar Pradesh.
Whereas the State Legislature is not in session and the Governor is satisfied that circumstances exist which render it necessary for him to take immediate action;
Now, Therefore, in exercise of the powers conferred by clause (1) of Article 213 of the Constitution, the Governor is pleased to promulgate the following Ordinance:—
## Section 1. Short title, extent and commencement.—(1) This Ordinance may be called the Indian Stamp (Uttar Pradesh Amendment) Ordinance, 2023.
(2) It extends to the whole of Uttar Pradesh.
(3) It shall come into force at once.
## Section 2. Amendment of Article 48 of Schedule 1-B of Act No. 2 of 1899.—In Article 48 of Schedule 1-B of the Indian Stamp Act, 1899 as amended in its application to Uttar Pradesh, for clauses (e) and (ee), the following clauses shall be substituted, namely:—
“(e)(i) When irrevocable authority is given to the attorney to sell the immovable property. | The same duty as a Conveyance [No. 23 clause (a)] on the market value of the immovable property which is the subject matter of the power of attorney. |
(ii) When authority to sell the immovable property is given to the attorney for consideration. | The same duty as a Conveyance [No. 23 clause (a)] on the market value of the immovable property which is the subject matter of the power of attorney. |
(ee)(i) When the members of the family [father, mother, husband, wife, son, daughter-in-law, daughter, son-in-law, brother, sister, grand son/grand daughter (son's son/daughter), grand son/grand daughter (daughter's son/daughter)] to be authorized with proof of relationship. | Rs. 5000/— |
(ii) When any person other than the members of the family mentioned in sub-clause (i) is authorized to sell the immovable property by means of Power of Attorney. | The same duty as a Conveyance [No. 23 clause (a)] on the market value of the immovable property which is the subject matter of the power of attorney.” |
