NOTIFICATION

No. H. 12018/73/96-LJD, the 1lth October, 1996. The following Act of the Mizoram Lagislative Assem-bly, which received the assent of the Governor of Mizoram is hereby published for general information.

The Mizoram Act No. 8 of 1996.

The Mizoram (Market), Regulation (Amendment) Act. 1996.

Received the assent of the Governor of Mizoram on the 7th October, 1996.

further to amend the Mizoram (Market) Regulation, 1954, to provide for the regulation and control of Markets in the State of Mizoram.

Be it enacted by the Legislative, Assembly of the State of Mizoram in the forty-seventh year of the Republic of India as follows:-

Short title ex-tent, and com-mencement

## Section 1. (1) This Regulation may be called the Mizoram (Market) (Amendment) Regu-

lation, 1996.

(2) It extents to the whole of the State of Mizoram excluding the areas under

the Autonomous Disric Councils of Lai, Mara and Chakma.

(3) It shall come into force on such date as the Governnment may, by notifi-

cation in the Official Gazette, appoint in this behalf.

(c) “Lessee” means settlement holder of a Market including shop and stall for

a specified period.

(f)

Meat” includes meat generally eaten in Mizoram.

(g) “seling rates” means the selling rate of meat and other commodities which

are sold by weighment within the area of the Markets.

(h)

Shop or Stall” means Shop or Stall constructed by the Government within the premises of the Market or Markets.

(i)

Market Officer” means any Officer so appointed by the Government for the purpose of this Regulation.

## Section 6. Any market wherein tolls, Taxes and revenue are assessed under section 5, shall be settled in public auction for a lease of 12 month (one year). The Government shall prescribe rules for the settlement of Mar-kets.

Power of Mar-ket Officer

7A.

The Market Officer shall have the power to setlle Shop or Stall with any person on lease by floating of tenders for a period not exceeding 2 years at a time and on such terms and conditions as may be prescribed.

Sub-letting of lease

7B.

No person to whom seat, shop or stall is alloted shall sub-let to any other person.

Allotment of seat inthe Market

## Section 10.

The Market Officer or any other Officer authorised by him shall have the power to allot or cancel seats in the Market for selling any commodity.

Rate to fixed by Market Officer

## Section 11.

The selling rates of Meat and other commodities which are sold by weighment shall be fixed and notofied by the Market Of ficer from time to time as may be requirred

Selling at higher rates

## Section 12.

No person shall sell meat and other commodities whcih are sold by wighment at a rate higher than the rate fixed and noti fied by the Market Officer.

Keeping stocking and selling of Pro-hibited articles

## Section 13.

No person shall keep, stock or sell any article prohibited by the Governemt within the premises of the Market or Markets from time to time.


 



 

Punishment

## Section 14.

Any person who contravenes any provision of this Regulation or any rule made thereunder shall be liable to punishment with a fine up to Rs.1,000/-(Rupces one thousand) or simple impris onment for a term not exceeding 3 (three) months or with both.
