An Act further to amend the Uttar Pradesh Private Universities Act, 2019.

It Is Hereby enacted in the Seventy Fourth Year of the Republic of India as follows:—

STATEMENT OF OBJECTS AND REASONS

The Uttar Pradesh Private Universities Act, 2019 (U.P. Act 12 of 2019) has been enacted to provide for the establishment of new Private Universities and incorporation of existing Private Universities in the State of Uttar Pradesh for imparting higher education and to regulate their functions and for matters connected therewith or incidental thereto.

In order to Provide for the establishment of three new Private Universities namely:—

(i) Agrawan Heritage University, Agra, Uttar Pradesh;

(ii) Mahaveer University, Meerut, Uttar Pradesh; and

(iii) SDGI Global University, Ghaziabad, Uttar Pradesh it was decided to amend Schedule-2 of the aforesaid Act.

Since the State Legislature was not in session and immediate legislative action was necessary to implement the aforesaid decision, the Uttar Pradesh Private Universities (Amendment) Ordinance, 2023 (U.P. Ordinance 6 of 2023), the Uttar Pradesh Private Universities (Second Amendment) Ordinance, 2023 (U.P. Ordinance 7 of 2023) and the Uttar Pradesh Private Universities (Third Amendment) Ordinance, 2023 (U.P. Ordinance 8 of 2023) were promulgated by the Governor on June 27, 2023.

This Bill is introduced to replace the aforesaid Ordinance.

## Section 1. Short title and Commencement.—(1) This Act may be called the Uttar Pradesh Private Universities (Amendment) Act, 2023.

(2) It shall be deemed to have come into force with effect from June 27, 2023.

## Section 2. Amendment of Schedule 2 of U.P. Act 12 of 2019.—In Schedule 2 of the Uttar Pradesh Private Universities Act, 2019 (hereinafter referred to as the “principal Act”) after serial no. 30, the Columns of the said Schedule shall be amended as below and after serial no. 30 for the newly established Universities the following serial numbers shall be inserted, namely:—

## Section 3. Power to remove difficulties.—(1) The State Government may, for the purposes of removing any difficulty in relation to the establishment of Agrawan Heritage University, Agra, Uttar Pradesh or Mahaveer University, Meerut, Uttar Pradesh or SDGI Global University, Ghaziabad, Uttar Pradesh by order published in the Gazette direct that the provisions of the principal Act shall during such period, as may be specified in the order, have effect subject to such adaptations, whether by way of modification, addition or omission, as it may deem necessary or expedient:

Provided that no such order shall be made after two years from the date of commencement of this Act.

(2) Every order made under sub-section (1) shall be laid before both Houses of State Legislature as soon as may be after it is made.

## Section 4. Repeal and Saving.—(1) The Uttar Pradesh Private Universities (Amendment) Ordinance, 2023 (U.P. Ordinance 6 of 2023), The Uttar Pradesh Private Universities (Second Amendment) Ordinance, 2023 (U.P. Ordinance 7 of 2023) and the Uttar Pradesh Private Universities (Third Amendment) Ordinance, 2023 (U.P. Ordinance 8 of 2023) are hereby repealed.

(2) Notwithstanding such repeal, anything done or any action taken under the provisions of the principal Act as amended by the Ordinance referred to in sub-section (1) shall be deemed to have been done or taken under the corresponding provisions of the principal Act as amended by this Act as if the provisions of this Act were in force at all material times.
